Contractors Missing Deadlines/Over Committing

Timely completion of civil construction projects is a growing problem. There is a common strategy among contractors to overcommit, winning as many contracts as possible, and then try to figure out how to deliver those commitments on time. The contractor will prioritize project delivery based on the project’s profitability or risk of liquidated damages first. The contractor primarily reacts to costs associated with contract language or client reputation for contract enforcement. A better understanding of contract language and how it influences a contractor’s willingness to complete a project on-time is needed to drive more consistent project delivery. The primary objective of this project is to produce an educational guide for agencies on contract language and processes that can improve the likelihood of a contractor delivering a project on time.
