Synthesis of Information Related to Airport Practices. Topic S01-12. Airport Participation in Oil & Gas Development

Airport sponsors are always in need of alternative sources of revenue. In some areas of the U.S. the pressures to reduce dependence on aeronautical revenues and local financial support can be supplemented through mineral development revenues. Airports with oil and gas assets are attractive to mineral development interests. The purpose of this synthesis is to provide understanding of the following issues: (1) Mineral leasing best practices to maximize revenue streams; (2) Environmental regulations and reclamation; (3) Health and life safety; (4) Maintaining safe airport operations; and (5) Establishing compatible land use off-airport. The researcher will compile literature and information from interview of airports on effective practices, dos and don'ts, and issues to resolve prior to developing minerals on or near airports. A concise report will include, at minimum: (1) FAA policy, federal regulations, and statutes pertaining to public airports; (2) Airspace safety and airport operational considerations; (3) Grant assurance issues; (4) Breadth of state regulations (i.e., range or general types of state regulations); (5) Variations between on- and off-airport development; (6) Relationships, parties to Agreements, and who needs to be a part of the process (e.g., specialized attorney, aviation planner, aviation engineer, property owner, state aeronautics); (7) Experience of airports that have undertaken mineral development or chosen not to develop; and (8) Appendices-Contracts, Lease Agreement and Stipulations, Well Permits, Best Practices for Well Site Control and Reclamation, etc.
