Efficient and Effective Ways to Manage Water Through ODOT's Temporary Access Fills During Construction

The goal of this research is to explore alternative ways for Ohio Department of Transportation (ODOT) to approach the management of water through temporary access fills (TAFs) and determine more effective ways to achieve compliance, assess damages, and determine who pays. In 2010, ODOT developed and implemented flow requirements for TAFs to facilitate compliance with Sections 404 and 401 permits and as a contract mechanism for damages. The elevation of the TAF is based on the ordinary high water mark, which is subjective and regulated by the US Army Corps of Engineers. While ODOT's flow requirements are effective the majority of the time, there are situations where these requirements cannot be met, which can present design challenges and, if not identified early in the project design process, can result in project delays.
